Importation of living plants or parts thereof of the family Rosaceae
Re the "Code rural" particularly article 349 ;
Re the order of 1 September 1964 on sanitary control of plants at importation ;
Re the order of 13 December 1973 on the importation of living plants or parts thereof of the family Rosaceae ;
Re the customs code, notably article 38 ;
Re the customs tariff ;
Re the decision of the Plant Protection Advisory Committee on risks entailed in the introduction of plant material originating or coming from countries contaminated by fireblight (Erwinia amylovora (Burrill) Winslow et al.) ;
It is ordered :
Article 1 - The importation to all customs areas, other than for transit, in the Metropolitan customs territory, including Corsica, of plants and parts thereof (excepting fruits and seeds) flowers and flowering branches, leaves and branches of the family Rosaceae and belonging to the genera : Crataegus L. and Cotoneaster B. Ehrh. (chap. 6, ex 06-02 A II, ex 06-02 D, ex 06-03 A and 06-04 B I). and coming from countries infected by Erwinia amylovora (Burrill) Winslow et al., the cause of fireblight of Rosaceae is prohibited.
Article 2 - The following countries are considered to be infected : Belgium, Canada, Denmark, United States, Mexico, New Zealand, Netherlands, Poland, Fed. Rep. of Germany, German Democratic Republic, United Kingdom and Turkey.
Article 3 - The importation to all customs areas, other than for transit, in the Metropolitan customs territory, including Corsica, of plants and parts thereof (excepting fruits and seeds) flowers and flowering branches, leaves and branches of the family Rosaceae (chap. 6, ex 06-02 A II, ex 06-02 D, ex 06-03 A and 06-04 B I) and belonging to the genera :
a) Cydonia Mill., Malus Mill., Pyracantha Roem., Pyrus L., Sorbus L., Stranvaesia Lindl. coming from all countries ;
b) Crataegus L., Cotoneaster B. Ehrh., coming from countries other than those listed in article 2 of the present order, is not authorized unless the following requirements are fulfilled :
1° No symptoms of Rosaceous fireblight (Erwinia amylovora (Burrill) Winslow et al.) should have been observed in the nursery of production, or in the surrounding area, in each the 2 growing seasons prior to export.
2° The plants should be packed in separate lots, and not mixed with plants of other genera.
3° All consignments must be accompanied by a phytosanitary certificate (cf. model in the appendix of the order of 1 September 1964 on sanitary control of plants at importation) with an additional declaration : "The consignments conform with French Phytosanitary Regulations".
Article 4 - The order of 13 December 1973 on the importation of living plants or parts thereof of the family Rosaceae is repealed.
Article 5 - Notwithstanding these provisions, the Minister of Agriculture may authorize importations destined for scientific establishments for research and experimentation.
